Terms of Service
These Terms of Service ("Terms") govern your access to and use of the SurplusBOM website at surplusbom.com (the "Site") operated by SurplusBOM ("we," "us," "our"). By accessing the Site or joining our waitlist, you agree to these Terms. If you do not agree, please do not use the Site.
1. What the Site does today
At this stage the Site is informational. It describes a planned marketplace for surplus construction materials and lets you join a waitlist to be notified when we launch. The marketplace itself — including listings, buyer-seller messaging, and any transactions — is not yet available through the Site.
2. Eligibility
You must be at least 18 years old to join the waitlist or use the Site. By using the Site you represent that you meet this requirement and that the information you provide is accurate.
3. The waitlist
Joining the waitlist places no obligation on you and grants you no guarantee of service. We may contact you about SurplusBOM's launch and related updates. You can unsubscribe at any time, as described in our Privacy Policy. We may close, change, or re-prioritize the waitlist at our discretion.
4. Acceptable use
You agree not to: (a) submit false, misleading, or third-party information without authorization; (b) attempt to disrupt, overload, scrape, probe, or compromise the Site or its infrastructure; (c) use the Site for any unlawful purpose; or (d) misuse the waitlist (for example, submitting bulk or automated signups).
5. Intellectual property
The Site, including its name, logo, text, graphics, and design, is owned by SurplusBOM and protected by intellectual property laws. You may not copy, reproduce, or create derivative works from the Site without our written permission, except as allowed for normal personal browsing.
6. Third-party content and links
When the marketplace launches it will aggregate and display materials listings from third-party sources. The Site may reference or link to third parties now or in the future. We are not responsible for third-party content, products, or practices, and a link is not an endorsement.
7. No warranties
The Site is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free.
8. Limitation of liability
To the fullest extent permitted by law, SurplusBOM and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of the Site. Where liability cannot be excluded, it is limited to the maximum extent permitted by applicable law.
9. Changes to the Site and Terms
We may modify or discontinue the Site (or any part of it) at any time, and we may update these Terms as the product develops. Material changes will be reflected in the "Last updated" date above. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
10. Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in California, unless otherwise required by applicable law.
